This is an agreement between Criustek, LLC and Criustek, LLC technicians and customer. Technician hereby warrants and grants an express warranty to the customer who purchases any service from technician as follows:
Technician hereby warrants that any service purchased under this agreement shall be performed to customer’s satisfaction. In the event that customer is not satisﬁed with a service rendered and an alternative agreement cannot be reached, technician agrees to refund or avoid billing customer for said service. Once customer agrees that service has been provided in a satisfactory manner, the service warranty shall be, at the discretion of technician, limited to a maximum of one hour of labor provided free of charge to correct any problems.
Except to the extent expressly provided here and above and in lieu of all other warranties, there are no warranties expressed or implied, including but not limited to any warranties of merchant ability or fitness for a particular purpose for the above described item or items.
Technician will assume no responsibility or liability for damages, destruction or alteration of customer’s computer hardware, software, or data directly or indirectly related to any service rendered by technician.
In no event shall technician be liable for any incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, loss of business or business opportunity, loss of use, etc. The liability of technician for actual proven damages for any cause whatsoever, regardless of the form of action, whether in contract or in tort or otherwise, including negligence, shall be limited to an amount equivalent to charges payable by customer under this agreement for the service during the period such damages occurred.
